الملخص

The Iraqi legislator organized the provisions of the administrative investigation in accordance with the State Employees Discipline Law No. 14 of 1991, where the administrative investigation is considered one of the most important legal measures taken by the administrative authority to investigate and determine whether or not tort responsibility is established and determines the employee who violates the law, regulations and instructions who deserves to impose disciplinary punishment … and it has a subject The research focused on the administrative investigation and its importance as a legal guarantee for the public employee, the regular functioning of the public office, and the reduction of violations by imposing the provisions of the law on the violating employee.

Is the administrative investigation sufficient to guarantee the administration’s right to evaluate the conduct of the provisions of the public job and not to violate the public servant’s duties in his job? Is it considered a fundamental legal guarantee for the public servant against the authority of the administration.
