The law applicable to disputes related to illegal immigrants

Abstract :There are no jurisprudential studies that address the issue of an illegal immigrant residing in the country to which they have migrated and becoming involved in disputes that require a legal framework to govern such conflicts. Despite entering the country illegally, this immigrant is often treated similarly to a foreigner who has entered the territory legally, with some exceptions. The laws that should be applied to disputes involving this immigrant have been reviewed, but there are certain aspects that the Iraqi legislator should have addressed by specifying the applicable law. Leaving this matter to the discretion of jurisprudence and the judiciary does not lead to achieving justice. The recommendations that should be considered by the legislator to reach the most appropriate laws governing disputes involving illegal immigrants have been outlined.
