Abstract

Compulsory Implementation does not appear in one form, as it may be directed to the implementation of the obligation in kind, which means that the creditor obtains in kind what the debtor has committed to, and this is the principle in execution. Its example is to take the object subject to the obligation of the debtor and hand it over to the creditor. If the principle in compulsory execution is to force the debtor to implement an object of what he is committed to, to be called compulsory execution, then this depends on the availability of certain conditions required by the law in the forefront of which is that the implementation in kind is possible. It is no longer possible to redress the debtor, so the creditor may request execution for a fee, and this is the second form, and this means that he demands the debtor to pay compensation for the damage he suffered as a result of non-execution, which includes the loss he suffered and the lost profits.
