The multiplicity of freedom-depriving penalties in the Palestinian penal legislation and their compatibility with modern punitive policy

هدفت هذه الدراسة التعرف على تعدد العقوبات السالبة للحرية في التشريع الجزائي الفلسطيني ومدى انسجامها مع السياسة العقابية الحديثة، ولتحقيق ذلك استخدم الباحث المنهج التحليلي القائم على تحليل كافة القوانين والتشريعات ذات العلاقة وهي قانون العقوبات الأردني رقم 16 لسنة 1960 وتعديلاته، والقرار بقانون رقم 10 لسنة 2018 بشأن الجرائم الإلكترونية وتعديلاته، والقرار بقانون رقم 18 لسنة 2015 بشأن مكافحة المخدرات والمؤثرات العقلية وتعديلاته، والقرار بقانون رقم 20 لسنة 2015 بشأن مكافحة غسل الأموال وتمويل الإرهاب وتعديلاته، وقانون مراكز الإصلاح والتأهيل الفلسيطيني رقم 6 لسنة 1998، وقد تطرقت الدراسة في المطلب الأول إلى ماهية تعدد العقوبات السالبة للحرية من حيث مفهوم تعدد العقوبات السالبة للحرية، وحجج المؤيدين والمعارضين للعقوبات السالبة للحرية، وفي المطلب الثاني تناولت الدراسة تعدد العقوبات السالبة للحرية في التشريع الجزائي الفلسطيني، وذلك في قانون العقوبات العام، والعديد من التشريعات الجزائية الخاصة، وفي ضوء ذلك توصلت الدراسة إلى مجموعة من النتائج أبرزها أنه لا ينسجم تعدد العقوبات السالبة للحرية مع السياسة العقابية المعاصرة القائمة على إصلاح وتأهيل المحكوم عليهم، كما لا ينسجم قانون العقوبات الأردني رقم 16 لسنة 1960 والمطبق في الضفة الغربية والتشريعات الجزائية الخاصة مع السياسة العقابية الحديثة، بينما انسجم قانون مراكز الإصلاح والتأهيل الفلسطيني رقم 6 لسنة 1998 مع السياسة العقابية الحديثة، وقد أوصت الدراسة بمجموعة من التوصيات أبرزها ضرورة تبني المشرع الفلسطيني مبدأ توحيد العقوبات السالبة للحرية، وحصر جميع العقوبات السالبة للحرية في عقوبة واحدة وهي الحبس، وخصوصاً أن الواقع العملي يشير إلى ذلك.
