Traditional and modern characteristics of organized crime

Abstract: The spread and expansion of organized crime has become an imperative due to the expansion of criminal gangs and the expansion of their criminal activities. Especially, in conjunction with the information revolution and the great development in the fields of communications and transportation. Organized criminal groups did not hesitate for a one moment, nor did they fail to take advantage of this development for their benefit and to use modern advanced technology in carrying out their crimes. Therefore, organized crime has become a scourge on the international community, and raises many procedural and substantive problems at the international and national levels. As a result, international organizations did not delay in submitting proposals and recommendations regarding combating the phenomenon of organized crime. Also, the United Nations and the International Criminal Police Organization did not hesitate to take effective measures to prevent the spread of this phenomenon and limit its effects. The United Nations encouraged all countries of the international community to ratify its convention on combating transnational organized crime including the agreement held in 2000 in Palermo. The agreement brought new mechanisms to address the epidemic of organized crime by strengthening international cooperation. This study produced many outcomes, the most important of which is: that the traditional legislative rules were not alone sufficient to confront the threat of organized crime and confront it. Because of the internal and international obstacles and problems it raises. We call on national legislators to strengthen means of international cooperation, and to establish many modern international agreements that keep pace with the revolution of development. © 2023 TUJR, College of Law, Tikrit University
