Abstract

Abstract: The widespread use of social networking sites, especially by public employees, and the serious violations that accompany it have negatively affected the work of public facilities in the absence of legal regulation for employees’ use of social networking sites. This has prompted some comparative legal systems to set controls for employees’ use of these sites to find a balance between the employee’s freedom to express opinion, which is guaranteed by the constitution, and his most prominent job duties, such as maintaining job dignity, obeying superiors, respecting colleagues and subordinates, and not disclosing public service secrets. These systems have proceeded to issue codes of professional conduct and regulations regulating employees’ use of social media, which has facilitated determining the disciplinary responsibility of the employee if he misuses these sites. In addition, the administrative judiciary in Iraq and comparative countries has tended to establish general legal principles that clarify the difference between the legitimate use of social networking sites and their misuse.
