Abstract

The victim, in general, is an important party in the criminal equation, as he is no less important than the accused, for whom studies have lengthened in providing protection. Rather, he is the direct victim of the crime, and who needs to provide adequate guarantees capable of restoring the balance that he lost due to the assault that occurred on him. Where he is given fair compensation commensurate with the severity of the damage he suffered as a result of the crime, in addition to providing psychological and social protection. As for the victim child in particular, he is directly affected by the crime committed against him, and this damage lies in the physical and moral injury affecting his life, so sufficient guarantees must be provided to compensate him for the harm he suffered, and since there are no special provisions that can be referred to, it is possible to refer to the general provisions contained in the Iraqi Code of Criminal Procedure and comparative legislation, related to compensation for damage resulting from the commission of the crime .
