Penal responsibility for providing incorrect information with the intention of obtaining the national card - analytical study in the light of Law No. 3 of 2016 -

Abstract: This research, tagged with (Penal responsibility for providing incorrect information with the intention of obtaining the national card (analytical study in the light of Law No. 3 of 2016)), deals with an important issue related to lying with the information provided by the person concerned with the intention of issuing the national card document or the registration copy document, Which is considered one of the innovations of the criminalization policy pursued by the Iraqi legislator in the National Card Law No. 3 of 2016, within the framework of Article (38) thereof, which punishes anyone who provides incorrect information with the intent to obtain a national card or a copy of the registration with a penalty of imprisonment for a period not exceeding (3) years and a fine of not less than (200,000) two hundred thousand dinars and not more than (1,000,000) million dinars, or one of these two penalties. This is a matter for the legislator, in order to deter anyone who tempts himself to mislead the law by presenting data or information contrary to the truth with the aim of obtaining the national card document or the copy of the registration document. We have dealt with the subject of the research according to a plan consisting of two sections, we devoted the first section to discussing the concept of the crime of providing incorrect information to obtain the national card, while the second section dealt with the elements of the crime and its penal effects, so that we conclude our research with a conclusion that includes the most important findings of the research in terms of results and proposals, we hope the legislator listens Therefore
