The Law Applicable on the Liability of Internet Service Provider

Abstract

         Internet service provider is considered a mediator between the internet and the user .He/she has limited potentials in accordance with what the state authorized and has abilities to connect internet to specific technological devices of the user. His/ her services are varied between technical and informatics services .In addition , the nature of the liability of Internet service provider varies according to the committed ultra-verses – tort or contractual liability affecting the applicable jurisdiction on the relationship between consumer ( Internet users ) and ( Internet service provider .(

            The lack of a special legal regulation in Iraq regulates such relationship, many legal questions arise mainly if we know that there is a special regulation for such relationship at the level of the American and European regulations and laws tackled in the study .Therefore, investigating this topic is needed as an attempt at deducing special commitment rules in line with to the electronic relationship nature having international character in question.
