Raised The Promis Of Preference In The Waiting Stage

  • Dr. Saeb Salih Ibrahim Al_Rubaie Al-Farabi University College

The state of waithood is the first stage of the promise of preference,  where the party remains waiting for the favourable decision to pass until the decisive moment when the promisor decides to implement his security.

The promise of preference as an initial contract creates a legal relationship between the parties through which the beneficiary of the compensation claim cannot be able because it is a probabilistic right based on general rules of interpretation, and the preferential right is transposable.

The right of preference shall also be expired by the idea of the time limit, the statute of limitations, and waiver of the right of preference, as well as for particular reasons.
