Jordanian legal organization of Shafagha-Comparative study-
Abstract
The subject of the Shaf'ah is an important topic which needs to be strictly accurate in the identification and processing of its texts because the pre-emption is considered a departure from the original since the original freedom of contract and the freedom of the owner of the property to behave in the Queen to whomever he wills but the interests and necessities of lifting the damage and avoiding its effects have necessitated Coming out on that original. The organization of the Intercession is based on the balancing of two considerations: the first: respect for the original in the freedom of contract and disposition, which requires consent in the transfer of the King and the second: the interest that is achieved by the introduction of the Shaf'ah. The topic was dealt with by what the Shaf'ah and its justifications as well as the characteristics of the lips and its contraindications in addition to its procedures and finally the fall of the Shaf'ah all this comparison between the Jordanian law and the Journal of Criminal Judgments and Egyptian law to find a discrepancy in the regulation of the intercession between those legal systems
