Abstract

     Can be defined delay penalty as the sums expected the administration to contracted sanction for breach duration of implementation, and compensation for the damage done to the administration without the need to prove, and as a threat aimed at ensuring the proper functioning of public utilities regularly and steadily without reference to eradicate it, so if it was the right of the administration to impose a fine the delay, without waiting for a court ruling, it also has the right to exemption, and if the legal basis for it is the authority of the administration in the conduct of public facilities regularly and steadily, there must be considerations for the exemption supports this foundation to confront what he suffered this right of denial.
