Promotion of employees in the context of the multiplicity of Iraqi legislations
Abstract
The present study deals with the legal system of the promotion in the public occupation, as it is one of the most important occupational systems, especially it is related to the guarantee of work flow in the administrative, staff as readiness for action and efficiency, in addition to that, it is a moral and material incentives to the employee since it has a direct connection to the employee needs, we can notice that the Iraq legal system has in treated in the rights of employees, especially has right to promotion to get higher job grade than the previous one, this is connected to certain subjective rules and conditions and procedural rules also. the existence of various Iraq legislations in this sphere leads to the ambiguity and misunderstanding of some of the legal clauses that should be practiced, that variety leads to the loss of this important right that the employee should get. The present study will show the meaning of the concept of the promotion, its conditions and its legal nature, we will discuss if the promotion is a right to the employee or it is a discretionary power to the administration. We will discuss also the subjective and procedural right of the employee promotion according to the laws that we will deal with.
