The implementation of the orders of the Presidents within the framework of the International Criminal Court
Abstract
The principal statute of the international criminal court has a possibility of justification that those who accused of committing international crimes were executing high orders of their leaders and chairman, So the article No.33 fixed the impact of the chairmen`s orders on the criminal responsibility of the subjects. We will find in this research that this was not mentioned at all where the international legislator in the core of the principal judicature required conditions should be present to execute the orders of the chairman where the criminal jurisprudence considered it a picture of moral coerciveness, which rules out the vicious will of the subordinate and then it denies the criminal responsibility of the subject.
