The legal nature of the license and commercial support contract (Franchise)

Abstract

The commercial license and support contract (franchise)  is of the most important mechanisms of unlimited investment at the present time, where the subject is one of the concerns of the contemporary law as a result of the advanced position in the economic and legal framework. This study is a serious attempt to find out the contentious legal nature of the  commercial license and support contract  (Franchise). The contract licensing and commercial support (Franchise) is a contract between two parties legally and economically independent based whereby the Franchisor award the Franchisee an approval of the use of one or more of the intellectual and industrial property or technical know-how for the production of goods or the distribution of its products rights or services under the brand produced by or used by the franchisor and in accordance with his instructions and under his supervision, exclusively in a specific geographic area and for a specific time with his commitment to provide technical assistance, in return  of a monetary sum  or  advantages or economic interests. After this study we have reached important conclusions and  necessary recommendations
