Abstract

     The doctor's report the forensic results of the consequent impact of criminal responsibility, because the evaluation of the competent judge of this report a significant impact in a statement this responsibility, by knowing meets the formal requirements and objectivity, and the extent to compel the judge taking it, and the statement of his freedom of negligence or lack of invoking it, or eliminate not to take it.
If these procedures impact on the functioning of the criminal case, especially in the case of objection opponents or the public prosecutor, and the extent of control of the Court of Cassation of the actions carried out by the trial court in the physician's discretion forensic report and analysis of the legal texts on the subject, and doctrinal views explaining so resulted in our present.
