Forensic defense within the framework of the International Criminal Court
Abstract
The principal statute of international criminal court in article No.31 set that no responsibility on the person if he behaves reasonably in defending himself, other person or indispensable properties to perform a combat mission in case of war crimes. Then, the system of Rome permitted defense concerning the right of legal defense to impede criminal responsibility on those, who committed international crimes and even though the idea of legal defense basically depended on the natural law, the international legislator depending on some national enactments assigned some compulsory conditions to be one of the reasons of permissiveness which deny the responsibility of the doer.
